The Banking & Finance practice advises Austrian and international banks, funds as well as national and foreign companies on all aspects of banking law and financings of all kinds.
Our main focus is on providing legal advice to lenders or borrowers (or other financing parties) in complex financing transactions in a national and cross-border context. We regularly advise on unsecured and secured (syndicated) loan financings (in particular, acquisition financings, asset financings and project financings) as well as on structured financings, trade financings, leasing transactions, factoring transactions and cash pooling structures. Given our excellent contacts with foreign law firms, we can provide tailor-made cross-border support for financing transactions.
We also regularly advise credit institutions and financial institutions on regulatory and supervisory law issues of banking law and lending law. In this context, we particularly focus on the advancing digitalization of the financial sector, FinTech companies and digital assets.
Our range of legal advice is rounded off by the Capital Markets Practice Group, which is comprehensively active in capital markets transaction, for example in the issuing of securities of all kinds or other capital market instruments.
Furthermore, we work closely with the Dispute Resolution Practice Group in order to bundle the expertise of our respective specialists in disputes, both in and out of court, as well as administrative proceedings, in particular with a banking contract or regulatory background.
Our lawyers not only have excellent legal expertise but also a sound economic understanding. Therefore, they are often called upon not only to draft draft and negotiate contracts but also to structure and administer financing transactions, enabling them to provide comprehensive and long-term support for our client's projects and goals.
